3. Artwork and Product Descriptions
3.1 I take reasonable care to ensure that descriptions, dimensions, photographs and other information about my artwork are accurate.
3.2 Artwork is handmade and/or individually produced. Minor variations in colour, texture, finish, brushwork, materials and appearance may occur. These variations are a natural characteristic of handmade artwork and do not necessarily constitute a fault.
3.3 Colours shown on a computer, tablet or phone screen may differ slightly from the colours of the physical artwork due to differences in screens and settings. These differences do not constitute a fault.
3.4 Dimensions and other measurements are provided as accurately as reasonably possible. Certain materials change their size depending on climate, weather, humidity etc. Please allow an error margin of 1 - 3cm.
4. Orders
4.1 When you place an order through my website, you are making an offer to purchase the goods.
4.2 Your order is accepted when I send you an order confirmation or otherwise confirm acceptance of your order.
4.3 I reserve the right to refuse or cancel an order where, for example, an item is unavailable, there has been an obvious pricing or listing error, or I am unable to fulfil the order for any reason.
4.4 If I cancel an order after you have paid, I will refund the amount you have paid for the cancelled order.
5. Prices and Payment
5.1 All prices are shown in pounds sterling (£), unless otherwise stated.
5.2 The price payable is the price shown at the time you place your order.
5.3 Any applicable delivery charges will be shown before you complete your purchase.
5.4 Payment must be made using one of the payment methods offered through my website.
6. Delivery
6.1 I will provide an estimated delivery timeframe for your order. Please allow 5 - 10 working days before shipping in general - unless another timeframe is given or agreed on (e.g when agreeing on a commission).
6.2 Delivery dates are estimates unless I have specifically agreed a particular delivery date with you.
6.3 I am not responsible for delays caused by circumstances outside my reasonable control, including delays caused by postal or courier services, severe weather, strikes or other events beyond my control.
6.4 I will package artwork with reasonable care to protect it during transit.
6.5 If your artwork arrives damaged, please contact me as soon as reasonably possible and provide photographs of the packaging and the artwork so that I can investigate the matter and arrange an appropriate remedy.
7. Your Right to Cancel
7.1 If you are a consumer purchasing standard, non-personalised goods through my website, you will generally have a legal right to cancel your order within 14 days of receiving the goods, without giving a reason.
7.2 To exercise this right, you must clearly tell me that you wish to cancel within the applicable cancellation period. You can contact me using the email address provided above.
7.3 After notifying me that you wish to cancel, you must return the goods to me without undue delay and normally within 14 days.
7.4 Unless the goods are faulty or I have agreed otherwise, you are responsible for the direct cost of returning goods following cancellation.
7.5 Returned goods should be handled with care. If the value of the goods has been reduced during the return, I may be entitled to make a deduction from the refund where permitted by law.
7.6 Where a valid cancellation is made, I will provide the applicable refund in accordance with UK consumer law.
8. Personalised, Bespoke and Commissioned Artwork
8.1 Certain artwork may be made specifically to your requirements, including commissioned, personalised or bespoke artwork.
8.2 Where artwork is made to your specifications or is clearly personalised, the usual 14-day cancellation right does not generally apply.
8.3 Before work begins, I will confirm the agreed specifications, which may include size, colours, subject matter, wording, materials and other requirements.
8.4 You are responsible for checking that any information, wording, names, dates, measurements or images supplied by you are correct.
8.5 Once work on a bespoke or commissioned piece has begun, cancellation may not be possible except where required by law or where I agree otherwise.
8.6 If a commissioned artwork does not conform to the agreed specification or is faulty, your statutory rights remain unaffected.
9. Faulty, Damaged or Incorrect Goods
9.1 I am legally required to supply goods that conform to the contract, including being as described and of satisfactory quality where applicable.
9.2 If you believe that an item is faulty, damaged or not as described, please contact me as soon as reasonably possible with details of the problem.
9.3 I will consider the issue and provide any remedy to which you are legally entitled.
9.4 Nothing in these Terms & Conditions limits or excludes your statutory rights.
10. Copyright and Intellectual Property
10.1 I retain copyright and other intellectual property rights in my original artwork, designs, photographs, illustrations and other creative work unless I have expressly agreed otherwise in writing.
10.2 Buying an original artwork or other physical item does not transfer copyright to the purchaser.
10.3 You may display artwork that you have purchased for your personal use, but you may not reproduce, copy, scan, photograph for commercial reproduction, resell reproductions of, or otherwise commercially exploit my artwork or designs without my written permission, except where permitted by law.
10.4 For commissioned artwork, copyright remains with me unless a separate written agreement states otherwise.
11. Photography and Promotion
11.1 I may photograph completed artwork for my portfolio, website, social media, exhibitions and other promotional purposes. If you do not wish for me to do so, please let me know in advance in written format.
11.2 If a commissioned artwork contains personal information, a customer's likeness, or other material that you reasonably expect to remain private, I will take reasonable account of this when deciding whether and how to use photographs of the completed work.
12. Risk and Ownership
12.1 Risk in the goods passes to you when you, or a person you nominate who is not the carrier, takes physical possession of the goods, subject to applicable law.
12.2 Ownership of the goods passes to you once I have received payment in full.
13. Events Outside My Control
13.1 I will not be responsible for a failure or delay in performing my obligations where this is caused by circumstances beyond my reasonable control.
13.2 If such circumstances significantly affect your order, I will contact you and discuss the available options.
14. Complaints
14.1 If you have a question, concern or complaint about an order, please contact me using the details above.
14.2 I will make reasonable efforts to resolve complaints fairly and promptly.
15. Privacy
15.1 Personal information provided when placing an order will be handled in accordance with my Privacy Policy.
15.2 Please see my Privacy Policy for information about how I collect, use and protect personal information.
16. Changes to these Terms
16.1 I may update these Terms & Conditions from time to time.
16.2 The Terms & Conditions applying to an order will be the version in force at the time the order is placed.
17. Governing Law
17.1 These Terms & Conditions are governed by the law of England and Wales.
17.2 If you are a consumer, you will also have the benefit of any mandatory protections provided by the law of the part of the UK in which you live.
18. Statutory Rights
18.1 Nothing in these Terms & Conditions is intended to exclude, restrict or otherwise affect any statutory rights or remedies that you may have as a consumer.
